This English version is a translation of our legally binding German Terms and Conditions (Allgemeine Geschäftsbedingungen – AGB). It is provided for convenience only. In case of any discrepancies or legal interpretation, the German version shall prevail.
§ 1 – Scope of Application
These Terms and Conditions apply to all use of this website and to all contracts concluded between you and us via our online store.
By accessing or using any part of our website or making a purchase, you agree to be bound by these Terms. If you do not agree, you may not use the site or our services.
§ 2 – Contract Conclusion
The product listings in our online store are non-binding offers. By submitting an order via the checkout, you are making a binding offer to purchase the listed product. A contract is only formed when we confirm your order via email or dispatch the goods.
§ 3 – Prices and Payment
All prices include VAT and are shown in Euros unless otherwise stated. Shipping costs are displayed separately.
You may choose from the payment methods offered at checkout. Payment is due immediately upon contract formation.
§ 4 – Shipping and Delivery
We deliver within the European Union unless otherwise agreed. Delivery times and shipping costs are provided during the checkout process.
Should a product not be available, we will inform you promptly. Partial deliveries are allowed if reasonable.
§ 5 – Right of Withdrawal (14-Day EU Rule)
Consumers have a statutory 14-day right of withdrawal. Full details, including how to exercise this right and a model withdrawal form, are available in our Return & Refund Policy.
§ 6 – Voluntary 30-Day Return Policy
In addition to your statutory rights, we offer a 30-day return period. The conditions and procedure are outlined in our Return & Refund Policy.
Return shipping costs under the voluntary return policy are borne by the customer.
§ 7 – Retention of Title
Goods remain our property until full payment has been received.
§ 8 – Warranty
Statutory warranty rights apply. If you receive a defective or incorrect product, please contact us immediately at hello@kooshl.com.
§ 9 – Liability
We are liable without limitation for intent and gross negligence. For simple negligence, we are only liable for breaches of essential contractual obligations (cardinal duties), and only for foreseeable damages.
We are not liable for damages resulting from improper use of our products (e.g., infrared heating cushions), unless caused by product defects or gross negligence.
§ 10 – User Comments and Submissions
If you send us comments, suggestions or content (with or without request), you grant us the right to use, edit and distribute that content without restriction.
We reserve the right to remove content that violates laws or third-party rights.
§ 11 – Data Protection
We process your personal data in accordance with our Privacy Policy, which forms part of these Terms.
§ 12 – Changes to the Terms
We reserve the right to amend these Terms at any time. The latest version is always available on this page. Continued use of our website or services constitutes acceptance of any changes.
§ 13 – Applicable Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If permissible, the place of jurisdiction is Essen, Germany.
